Frequently Asked Questions

What’s the difference between a fiancé(e) visa and a marriage-based green card?
A fiancé(e) visa (K-1) allows a foreign national to enter the U.S. to marry a U.S. citizen within 90 days, followed by applying for a green card. A marriage-based green card is for couples who are already legally married.

Can I sponsor a spouse or child living outside the U.S.?
Yes. This process is called consular processing. We assist with petition filing, communication with the National Visa Center, and coordination with U.S. embassies abroad.

How long does it take to sponsor a family member?
Timelines vary. Spouse and fiancé(e) cases generally take 9 to 19 months, depending on the processing center and embassy wait times. Cases involving parents or siblings may take longer due to visa limits.

Can you help if my family sponsorship application was refused?
Yes. At YA Law, we have successfully assisted clients whose I-130 petitions were denied by filing motions to reopen, and our intervention has led to the reversal of the refusal and eventual approval of the petition.

Do you work with clients outside of Vancouver or Canada?
Yes. While based in Vancouver, we represent clients across North America, Europe, and the Middle East. Virtual consultations and cross-border representation are a core part of our practice.
