TN Eligibility Requirements for Canadian Nurses

The TN work permit under the United States-Mexico-Canada Agreement (USMCA), previously known as NAFTA, allows qualified Canadian and Mexican professionals to work in the U.S. in certain designated occupations, including registered nurses (RNs). Nurses who meet specific requirements can take advantage of this visa to work in the U.S. without the complexities associated with other visa categories.

TN work permit for Nurses:

  • Eligibility: Registered nurses (RNs) from Canada and Mexico are eligible for the TN visa. They must have a job offer from a U.S. employer for a position as a registered nurse and meet the educational and licensing requirements to practice nursing in the U.S. Typically, this includes:
    • Meet the Minimum Requirements.
    • A Bachelor’s or Associate’s degree in Nursing.
    • Passing the Nursing exams in the USA/ The National Council of State Boards of Nursing (NCSBN) develops the NCLEX exam to test the competency of nursing school graduates in the U.S. and Canada.
    • A valid state nursing license from the state where they will be employed.
    • In some cases, additional certifications or training may be needed, depending on the state’s specific requirements.
  • Duration: The TN status for nurses is valid for up to three years, with the possibility of renewal in additional three-year increments as long as the nurse continues to meet the visa requirements and remains employed in a qualifying nursing role.
  • Application Process:
    • Canadian Nurses: Can apply directly at a U.S. port of entry or pre-flight clearance point by presenting proof of their professional qualifications and the U.S. job offer.
    • Mexican Nurses: Must apply for a TN visa at a U.S. consulate before travelling to the U.S., and undergoing the necessary visa interview.
  • Work Authorization: Once the TN work permit is granted, nurses can start working for their U.S. employer immediately. They are limited to working only for the employer listed in their TN application.
  • Dependents: The spouse and children (under 21) of TN visa holders can accompany them, though they are not permitted to work in the U.S. on TN status.
